A Denial Letter Must Be Converted Into Testable Issues
An insurance denial does not by itself show whether an Albuquerque claim is over or what response is available. The letter may dispute coverage, responsibility, causation, damages, procedure, or missing documentation. A personal injury claim lawyer should identify the exact adverse position, the policy or fact cited, every response deadline, and what record could confirm or challenge the decision.
Verify What the Insurer Actually Denied
Read the complete letter, attachments, cited policy provisions, claim number, insured and claimant names, date of loss, stated facts, exclusions, reservations, and instructions. Determine whether the insurer denied the entire claim, one coverage, a particular expense, liability, medical causation, amount, or only payment pending more information.
Compare the letter with the application, declarations, full policy and endorsements, notices, recorded or written statements, proof already submitted, investigation materials, medical records, repair or loss documentation, and prior communications. A missing-document request should not be analyzed as though it were a final interpretation of coverage.
Create a Response Track for Each Denial Reason
For a factual error, identify the source record and provide a focused correction. For alleged noncooperation or late notice, build a chronology of requests, responses, delivery, receipt, and any claimed prejudice. For causation or damages, organize treating records, prior history, diagnostic proof, work restrictions, expenses, and the insurer’s contrary material. For a policy interpretation, preserve the exact text and all related endorsements.
An accident settlement lawyer should not send a generic demand that ignores the stated basis. The response should say which proposition is disputed, which evidence addresses it, what remains unavailable, what review is requested, and which deadline remains open.
Choose Only Procedures That Actually Exist
The available route may include supplying documents, requesting reconsideration, using an internal review, contacting a regulator, negotiating, invoking appraisal or arbitration, or filing suit. Availability depends on the policy, claim type, parties, current law, and procedural posture. Do not assume that every insurer offers an appeal or that a complaint pauses a contractual or statutory clock.
Preserve limitation clauses, proof-of-loss requirements, suit provisions, arbitration language, regulator information, and all legal deadlines on one calendar. Continue complying with reasonable policy duties while reserving disputed positions in writing.
Use a Denial-Response Verification Sheet
Record the denial date, delivery date, exact issue, cited policy text, supporting facts, contrary evidence, missing documents, response method, reviewer, regulator option, contractual deadline, legal deadline, and next decision. Attach the correspondence log and proof of transmission. This turns a broad rejection into a bounded set of questions that can be answered or litigated. At S&S Law, we help Albuquerque clients with claim denial responses.
