Identify the Claim Route Before Trusting Any Filing Date
There is no single filing deadline for every Albuquerque injury matter. Under New Mexico Statutes Section 37-1-8, an action based on injury to person or reputation ordinarily has three years, but the correct clock can change with the defendant, claim type, accrual rule, notice requirement, administrative forum, repose rule, or insurance contract. A personal injury claim lawyer should verify the route and its starting event before anyone relies on that ordinary period.
First, Distinguish Notice From Filing a Lawsuit
Some matters require a notice long before the civil limitations period expires. For many New Mexico Tort Claims Act occurrences, Section 41-4-16 supplies a 90-day written-notice framework, with six months for wrongful death and an actual-notice provision that needs exact review. The public entity, proper recipient, content, and method of delivery all matter; placing a reminder three years out would not protect that step.
Insurance policies and benefit programs may also require prompt reporting or proof. A contract notice, an employer report, an administrative filing, a complaint, and service of process are different acts. Record the date and proof for each one instead of calling all of them a “claim.”
Second, Route Work and Death Matters to Their Own Clocks
New Mexico’s workers’ compensation framework begins with a prompt 15-day notice period and describes an outer 60-day structure subject to exceptions. A separate provision concerns commencement of proceedings when compensation has not been paid. Report the injury immediately and preserve how notice was given. Work status, employer knowledge, excuse, coverage, payment history, occupational disease, and outside-party involvement can change the analysis.
Wrongful-death statutes generally use three years after death and place the action with the personal representative for statutory beneficiaries. Appointment, survival claims, medical malpractice, government involvement, and beneficiary issues require separate review. An accident settlement lawyer should not substitute the ordinary injury date for the legally relevant death or notice date.
Third, Check Exceptions, Repose, and the Correct Starting Event
Accrual and discovery can determine when a clock begins, while tolling may pause a period in limited circumstances. A statute of repose may impose an outside boundary that functions differently. Medical malpractice, products, abuse, minors or other disabilities, alcohol-provider claims, and federal causes of action can use rules that do not match Section 37-1-8.
Gather the event date, first discovery of harm, death date if applicable, claimant status, defendant identity, professional or product involvement, government status, employer notice, benefit decisions, and every policy communication. The official New Mexico Compilation Commission law search provides the current statutory starting point, but the controlling text and case law must be checked as of filing.
Create a Multi-Clock Verification Sheet
Use a separate row for each potential route. Record the triggering event, required act, recipient or forum, stated deadline, source, proof of completion, and open legal question. Mark unverified dates prominently. That approach reveals the earliest unresolved duty and prevents a general web answer from becoming the only calendar for an Albuquerque claim.
