When a crash injures you and totals your car

A Mason driver may be dealing with treatment, missed work, and a car the insurer says is a total loss. The vehicle offer arrives with its own figures and documents, sometimes before the injury picture is clear. Auto accident lawyers can help an injured person sort the two tracks, but a personal injury consultation is not a promise to handle a standalone property claim. S&S Law can discuss whether an appropriately licensed Ohio lawyer is available to review the injury matter and explain which parts of the insurance process the firm would undertake if representation is accepted.

Ask for the calculation, not just the number

Save the total loss letter, valuation report, declarations page, photographs, repair estimate, and every message about the vehicle. Mark the vehicle identification number, trim, mileage, options, prior damage, condition notes, and the date the offer was made. If the report lists comparison vehicles, note their locations, sale or listing dates, mileage, and differences from your car. A low figure may reflect a bad comparison, a disputed condition deduction, or a missing option. Those are different questions, and each calls for different proof.

Ohio Administrative Code rule 3901-1-54 sets minimum claims practice standards for Ohio property and casualty insurers. Under paragraph (H)(7), when an insurer chooses a cash settlement for an automobile total loss, the offer must be based on the actual cost to purchase a comparable automobile, subject to applicable deductible or betterment deductions. The rule allows several valuation sources, including recent comparable automobiles in the local market, certain nearby markets if local examples are unavailable, dealer quotations in specified circumstances, or a recognized vehicle industry source. The chosen route matters because it tells you what to request and test.

Read the comparisons in context

If a report uses local cars, check whether the examples were available within the rule’s ninety day window and how the vehicle details compare. If it moves to a nearby market, ask why the local market did not supply the required comparables. If it uses an electronic valuation database, the rule calls for the insurer to provide pertinent portions of the generated valuation documents on request. For a public guidebook, the insurer must identify the guidebook on request and document appropriate adjustments for condition, mileage, and major options. Auto accident lawyers can help an injured claimant frame these as precise questions rather than an unsupported demand for a different number.

Do not assume every listed car is a true substitute. Keep screen captures with dates if a listed example cannot be found or has a different engine, trim, or equipment. Preserve service records or dated photographs that fairly show your own car’s precrash condition, including unfavorable facts. Ask the insurer to identify each deduction and the supporting information. The rule says betterment and other stated reductions have to be documented and, where applicable, itemized. That does not mean every deduction is unlawful; it means its basis should be visible enough to examine.

Separate a first party right from a general request

Some details depend on whose policy pays. Paragraph (H)(7) gives a first party claimant a right to request documentation used to determine a cash total loss and requires notice of any rights to renegotiate if a comparable vehicle is not available for purchase within thirty five days of receiving the settlement. It also addresses sales tax when a replacement automobile is purchased within thirty days, with specific documentation and timing conditions. Do not treat those provisions as an automatic extra payment in every third party claim. Ask which coverage is being used, retain proof of any replacement purchase, and request a written explanation of the insurer’s position.

The rule itself says it does not create a private cause of action. A discrepancy in a valuation report is a reason to ask a focused question or seek advice, not proof that a lawsuit will succeed. The property figure also does not measure the value of pain, treatment, or lost income. Keep the vehicle file and the injury file clearly labeled. If an insurer sends a check, release, or broad settlement form, read its coverage and claim language before signing, especially when treatment or future needs are still uncertain.

Bring the issue to an injury consultation

Bring S&S Law the crash date, injury treatment chronology, coverage information, vehicle offer, valuation pages, and correspondence. Ask an auto accident lawyer which issues belong in a potential injury representation, whether the firm would review any proposed release, and who would address a separate vehicle value dispute if it falls outside the engagement. Auto accident lawyers should explain their actual scope in plain language. A careful division of work lets you challenge a supported valuation error without mistaking the property settlement for the whole injury claim.
