Claim Value Is a Changing Evidence-Based Range, Not a Calculator Output
An Atlanta injury claim is not calculated through one multiplier or average. A defensible range depends on recognized loss categories, proof, causation, responsibility, defenses, coverage or assets, repayment obligations, expense, timing, and collection risk. An attorney for injury claim analysis should state the assumptions behind each scenario before comparing it with an offer or accident lawsuit.
Build the Supported Gross Picture One Category at a Time
Use separate ledgers for treatment costs, work loss, property, future needs, and documented human consequences. Every line should identify amount or range, source, causal basis, governing legal question, contrary evidence, and uncertainty. Keep paid, outstanding, disputed, projected, and reimbursable figures distinct to avoid duplicate counting.
Future items need a qualified basis, timing, duration, probability, cost source, and alternatives. A present recommendation is not automatically a lifetime total. Prior conditions, later events, gaps, changed employment, mitigation, and unrelated economic factors should be visible rather than removed from the model.
Then Apply Responsibility and Practical Constraints
Georgia Code § 51-12-33 generally reduces damages according to claimant fault and generally bars recovery at an assigned share of 50 percent or more, with allocation and claim-specific issues requiring exact review. Model more than one supported fault scenario instead of treating an insurer’s early percentage as final.
Identify each applicable policy or asset, coverage dispute, limit question, consent or notice term, public-defendant restriction, benefit payment, repayment demand, expense, and collection obstacle. Gross supported loss and likely net distribution answer different questions. Neither should be presented as a guaranteed recovery.
Update the Range When a Material Assumption Changes
Create conservative, central, and higher supported scenarios. For each, list the evidence accepted, disputed loss excluded, fault share, coverage assumption, expense estimate, unresolved lien, timing, and litigation risk. A new medical opinion, witness, policy document, ruling, payment record, or work development can justify recalculation.
The useful output is a dated valuation memo with cited sources and a change log, not a permanent number. Before relying on it, confirm the gross-to-net reconciliation and identify the assumption most likely to move the range. Record who owns the next investigation step and when the memo will be revisited. That transparency supports an informed decision without disguising uncertainty as mathematical precision or presenting collection as certain. At S&S Law, we help Atlanta clients with claim valuation.
