Medical Costs Need Treatment, Causation, Payment, and Reimbursement Proof Before Valuation
Accident-related medical costs may be recoverable in an Atlanta claim when the governing law recognizes them and the evidence supports treatment, causation, amount, and necessity, but an invoice alone does not settle those questions. An attorney for injury claim review should separate billed, allowed, paid, patient-paid, outstanding, disputed, reimbursable, and future figures before presenting medical loss in an accident lawsuit.
Tie Each Line Item to Care and the Event
Record provider, date, service, diagnosis, itemized charge, clinical note, referral, and the reason the treatment is connected to the incident. Compare symptom onset, examinations, prior related conditions, later injuries, gaps, and provider reasoning. A charge can prove that billing occurred without proving another party legally owes it.
Build a chronology that distinguishes emergency evaluation, diagnostic studies, rehabilitation, specialist visits, procedures, prescriptions, assistive devices, and transportation tied to care. Preserve source statements, clinical records, payment notices, and explanation-of-benefits documents. Correct identity or coding issues through the provider or payer process instead of modifying the source copy.
Separate the Four Financial States and Future Care
For every service, list the provider’s charge, negotiated write-down, each private or public payer contribution, the client’s payment, present balance, denial explanation, appeal posture, and collection activity. Keep paid, outstanding, disputed, and projected amounts distinct. The categories can affect proof, negotiations, repayment, and closing distribution differently.
For projected treatment, identify the proposed service, supporting medical reasoning, expected schedule, likely source of care, pricing basis, alternatives, and uncertainty. A possibility should not be converted into a guaranteed lifetime total. Distinguish a documented recommendation from a projection the record cannot yet support.
Verify Liens and Reimbursement Before Estimating Net
A private health plan, government program, treatment provider, auto benefit, or another funding source may claim a right to reimbursement or priority from a recovery. Verify who asserts the claim, its governing document or statute, included services, calculation, challenge procedure, and current payoff. Do not assume every demand is valid or that silence eliminates an obligation.
Maintain one table for providers and services, a second for payer activity, a request audit, and a folder for repayment correspondence. Produce three separate totals: documented historical care, a qualified future-care estimate, and disputed amounts requiring causal or payment review. Add the source date for every figure. Together they show gross and possible net without promising recovery. At S&S Law, we help Atlanta clients with medical expenses.
