Measure Miami Representation Cost Through the Written Agreement
The cost of hiring Miami counsel depends on the specific engagement agreement, not a universal price. A proposal may tie compensation to recovery, change the percentage at defined stages, allocate case expenses in a particular order, and address what happens if there is no recovery or the relationship ends early.
Turn the proposed contract into a one-page money map. Start with funds received, then show the fee base, applicable percentage, reimbursed spending, medical or benefit obligations, other authorized deductions, and projected client distribution under several outcomes.
Separate Legal Fees From Case Spending
Ask an accident attorney to identify the event that earns a fee and the exact amount used for the calculation. List every milestone that changes the rate, including filing, testimony, trial preparation, appeal, or collection, and request numerical examples based on the language offered.
Build an expense budget for records, filing, service, investigation, testimony, experts, travel, demonstratives, and other vendors. For each category, record the initial payer, client-approval threshold, repayment sequence, unsuccessful-result treatment, and documentation the client will receive.
Keep Outside Balances in Their Own Column
Medical bills, health-plan reimbursement, liens, funding, taxes, and benefit adjustments are not automatically lawyer compensation, though they can affect the net. Identify the claimant, present amount, supporting statement, dispute status, negotiation authority, and expected closing treatment for each one.
A personal injury attorney should explain trust handling, settlement-statement review, client approval, and how disputed funds are treated. Do not accept a projected net that hides unknown obligations inside one unexplained reduction.
Model Early Exit and No-Recovery Outcomes
Read the clauses governing early termination, lawyer departure, delivery of the file, later counsel, asserted fee interests, division of compensation, unfinished spending, and disagreements. Determine how each applies if representation stops before settlement or another firm later completes the work.
Run examples for an early settlement, filed litigation, trial or appeal, termination, and no recovery. Compare the client's responsibility and estimated net, not merely the advertised percentage.
At closing, require an itemized distribution showing deposited funds and every authorized subtraction, supported by the agreement, invoice, or current third-party statement. Reconcile the final sheet with earlier approvals and preserve the signed version with the payment record. Ask for clarification before authorizing any line that lacks a source or differs from the modeled examples. At S&S Law, we help Miami clients with representation costs.
