A Contingency Arrangement Is a Contractual Calculation, Not a Slogan

A contingency arrangement generally ties attorney compensation to a contractually identified recovery. The contract, not a general advertisement, must identify what counts as recovery, the calculation base, the percentage or tier, the stage that changes it, and the event that makes payment due. Denver clients should also identify expenses and outside obligations that follow different rules, then keep the signed version available for later reconciliation.

Translate Each Fee Clause Into a Matrix Row

Rows should cover settlement, judgment, structured payment, noncash benefit, appeal, retrial, termination, withdrawal, and no recovery when mentioned. Columns should state trigger, fee base, rate or method, responsible payer, timing, and required closing document. Personal injury attorneys should explain the matrix without inventing a standard rate.

If the agreement changes compensation after filing, discovery, trial setting, or appeal, identify the precise event rather than using a vague phrase such as more work. Ask how partial recovery, multiple claims, benefit payments, or later installments are treated. Resolve inconsistent examples and contract text in writing.

Build a Separate Expense and Deduction Ledger

No scenario should be assumed cost-free without the approved terms.

Three priorities are to obtain the signed complete agreement, request a clause matrix for four outcomes, and require a final reconciliation from gross to net. The client should also know who answers billing questions, how often expense records are available, and which document controls if an illustration conflicts with the contract.
