Test an Orange Claim as a Supported Hypothesis
An Orange injury case may exist when reliable facts connect a person or organization’s legal responsibility and wrongful conduct to a documented injury and loss, within the applicable time and procedure. The occurrence of an accident plus an injury starts the inquiry; it does not complete the required proof.
A lawyer for personal injury can test the theory without assuming the conclusion. The review should identify the strongest evidence, the missing link, the likely defense, and whether insurance, assets, or another remedy make the claim practical.
Write One Sentence for Each Necessary Link
Describe what the proposed defendant was required to do, the specific act or omission at issue, how that conduct produced the event, how the event produced the claimed condition, and what economic or personal losses followed. Attach a document, witness, image, record, or other source to each statement when possible.
If a link rests only on assumption, label it unresolved. For example, a wet floor photograph may show a condition but not who controlled it, how long it existed, whether a warning was present, or why a particular injury followed.
Stress-Test Alternative Explanations
Compare the account with incident reports, video, physical damage, medical chronology, prior conditions, later events, work records, and the other side’s version. Consider comparative responsibility, consent, assumption-of-risk questions, product misuse, employment status, and other defenses that fit the facts.
A personal injury law firm should distinguish a factual gap that can be investigated from a legal barrier that changes the available claim. It should also check the correct defendant, deadline, forum, insurance, and cost of obtaining necessary expert proof.
Use the Screen to Choose the Next Investigation
Create a one-page chart with columns for element, supporting source, conflicting source, missing proof, preservation step, and deadline. Prioritize evidence that can disappear or be changed and records controlled by another party.
A professional evaluation can then answer a concrete question: what additional fact would materially strengthen or defeat the theory? That is more useful than a quick yes-or-no label based on an incomplete story.
Bring the chart to the consultation and ask counsel to rank each gap by importance, urgency, and availability. A missing camera file and an unsettled prognosis call for different work even though both entries remain unknown. At S&S Law, we help Orange clients with potential injury claims.
