Before signing, audit released parties and claims, medical status, liens, expenses, allocation, confidentiality, payment conditions, approvals, tax questions requiring separate advice, and estimated net proceeds. Confirm the client’s authority and decision in writing.
Track signature, delivery, any required dismissal, lien handling, payment deadline, clearance, and final distribution. A resolution outside court has practical value only if the parties understand it, can enforce it, and complete every required administrative step.
Keep a Court-Readiness File During Negotiation
Maintain verified party names, service information, evidence custodians, witness locations, expert needs, damages support, and a draft limitations analysis even while settlement discussions are productive. That preparation prevents a failed negotiation from consuming the time needed to file properly.
