Changing Counsel Requires a Verified Handoff
Switching lawyers may be possible in a Lake Havasu City injury matter, but the handoff must preserve live dates, proof, confidential information, court appearances, and financial positions. Before ending the current injury attorney relationship, identify the problem, study the engagement, secure a replacement decision, and assign every transition task in writing.
Create a handoff dashboard with four owners: current counsel, prospective counsel, client, and court or third party. Place every document, deadline, notice, payment, appearance, and evidence item under the person who must complete or acknowledge it.
Diagnose the Problem Before Ending the Relationship
Classify the concern as communication, strategy, staffing, confidence, settlement authority, economics, or missed work. Bring dated examples to a focused conference when appropriate. A documented issue may permit correction and gives replacement candidates a reliable explanation rather than an emotional summary.
Personal injury attorneys assessing a takeover need party names for conflicts, procedural posture, near-term dates, core proof, medical status, spending, proposals, and the present contract. Limit confidential disclosure until the conflict screen is complete.
Inventory the File and Formal Status
Catalog pleadings, disclosure, hearings, time limits, public notices, policy conditions, preservation activity, specialists, negotiations, trust balances, and client property. Identify originals, native electronic material, missing productions, and work due during the change.
For a pending action, determine the exact consent, substitution, withdrawal, or judicial-approval procedure. Ending a private agreement does not by itself update the docket or excuse existing orders.
Resolve Authority, Fees, and Custody
Compare the existing agreement and governing law on termination, costs, contingency interests, claimed liens, document delivery, and dispute handling. Record the outgoing claim, incoming pricing, unresolved charges, and possible effect on later distribution.
Incoming counsel should issue a receipt for the indexed production, flag omissions, adopt verified dates, and establish secure communications. Insurers and other participants should receive authority changes only through the appropriate formal method.
Audit the first two weeks after substitution: docket appearance, file completeness, pending discovery, evidence custody, insurer contacts, client property, and calendar entries. The handoff is complete only when every active obligation has an acknowledged owner.
Request a short transition memorandum from incoming counsel listing the next three decisions, missing proof, and any date at risk. That document gives the client a concrete way to confirm that the new team understands both the record and the immediate priorities. At S&S Law, we help Lake Havasu City clients with changes in counsel.
