Contingency Terms Must State the Recovery Base, Rate, Costs, and Payment Trigger
With a contingency arrangement, the lawyer’s fee is ordinarily calculated from a recovery according to the signed contract instead of being billed solely by hours as work occurs. The document controls the percentage or tiers, calculation base, covered matter, payment trigger, and treatment of no recovery. Before hiring a Birmingham injury lawyer, review every clause; personal injury law does not make all contingency agreements identical.
Read the Calculation in the Order It Operates
Identify what counts as recovery, whether the calculation uses a gross or another defined base, the applicable percentage, any stage change, and how structured, noncash, property, or multi-claim proceeds are treated. Mark the event that triggers payment and whether an appeal or separate proceeding changes the arrangement.
Request sample arithmetic for an early resolution, a filed matter, and no recovery. Each example should label hypothetical gross proceeds, fee base, percentage, case expenses, third-party obligations, and possible client distribution. Examples explain mechanics; they are not predictions about value or outcome.
Separate the Legal Fee From Every Other Deduction
Case costs may include filing, service, records, investigation, experts, depositions, mediation, exhibits, or other work. Determine who advances them, who approves substantial spending, their place in the calculation sequence, and the stated no-recovery responsibility. Use only the actual agreement for the answer. Ask when an updated expense ledger can be requested and how a disputed entry is handled.
Medical balances, liens, benefit reimbursement, taxes requiring separate advice, and other authorized deductions are not automatically part of the legal fee. Ask how disputed claims are handled and when a closing statement will show gross proceeds, each subtraction, and the resulting client amount.
Test Termination, Transfer, and Closing Terms
Review client termination, lawyer withdrawal, substitution, file transfer, fee division, asserted lien, expense repayment, dispute procedure, and authority to endorse or hold funds. If another lawyer may participate, identify roles and how any division affects the total obligation under current rules and the agreement.
Keep the executed contract, amendments, expense policy, explanations, and illustrative calculations. Write down unresolved clauses before signing. Date every answer supplied outside the agreement. A meaningful comparison uses the same fields across firms: calculation base, stage tiers, costs, no-recovery treatment, termination, deductions, and closing accounting, not one advertised number. At S&S Law, we help Birmingham clients with contingency fees.
