Can I File A Claim If The At-Fault Driver Was Uninsured In Birmingham, AL?

Verify Liability Coverage First, Then Trace Every Possible First-Party Policy

You may still have a claim after a Birmingham crash with an uninsured driver, but legal responsibility and a collectible recovery source are separate questions. First verify that no applicable liability policy covers the driver, owner, vehicle, employer, or another responsible party. A hit and run attorney can address an unidentified vehicle scenario, while an uninsured motorist attorney should examine every potentially applicable policy and its conditions.

Verify the Coverage Gap Instead of Assuming It

Collect driver, owner, vehicle, plate, employer, household, and use information. Preserve coverage searches, reservation letters, denial notices, cancellation records, declarations, and the complete liability policies located. Determine whether permissive use, employment, rideshare, rental, commercial, umbrella, or another relationship warrants investigation.

Liability proof still matters. Preserve scene media, reports, witnesses, traffic controls, event data, vehicle condition, medical records, wage proof, and claimed losses. A first-party carrier may dispute fault, causation, or damages even when its insured did not cause the collision.

Inventory Every Possible Uninsured-Motorist Policy

Alabama Code § 32-7-23 generally requires uninsured-motorist coverage in covered auto liability policies unless the named insured rejects it in writing, and its definition includes specified underinsured situations. Application depends on the actual policies, endorsements, rejection material, insured status, occupancy, vehicle, priority, limits, offsets, and current law.

Gather policies for the occupied vehicle, claimant, household members, employers, platforms, and other plausible sources without assuming stacking or priority. For each, record named insureds, covered vehicles, limits, exclusions, notice terms, consent provisions, proof requirements, arbitration or suit language, and limitation clauses.

Protect Policy Duties and Settlement Rights

Report through the proper channel and keep delivery proof. Distinguish factual notice from a recorded statement, examination, authorization, sworn form, or release. Do not settle with or release another party before checking whether a policy requires notice or consent and what effect the document may have.

Use a coverage matrix showing policy, insured theory, notice date, requested action, response, limit, defense, and next deadline. Add noninsurance assets only after lawful investigation. Preserve all superseded policy versions and denial explanations for comparison. Add the custodian and follow-up owner for every missing contract. The matrix reveals which path remains possible and which fact is missing, without treating policy identification as a guarantee of payment. At S&S Law, we help Birmingham clients with uninsured driver claims.
