A Potentially Supportable Case Needs Proof of Responsibility, Causation, Loss, and Timely Action
An Atlanta injury may support a legal case only if reliable sources identify someone answerable under the governing rule, connect specific conduct to the harm, document compensable loss, and show that required procedures remain available. A personal injury law firm should test defenses, coverage, public-entity issues, and deadlines before predicting viability. A lawyer for personal injury cannot establish the necessary elements from the claimant’s account alone.
Identify the Actor, Governing Rule, and Conduct
Ask who directed the vehicle, premises, jobsite, product, professional service, or disputed decision and which duty or statute may govern. Then identify the specific act or omission, timing, supporting source, contradiction, and causal theory. Ownership, employment, contractual roles, delegated authority, actual control, and governmental identity determine which people or organizations warrant review.
Preserve reports, native photographs or video, physical evidence, electronic data, contracts, policies, maintenance, training, witnesses, communications, and technical material. A citation, incident report, or adverse result may support one fact without resolving the civil standard or every participant’s share.
Test Medical Causation and Loss as Separate Proof Chains
Build a dated record of first complaints, clinical visits, diagnoses, studies, treatment, limitations, expected course, earlier related health issues, and subsequent incidents. In a different ledger, document medical charges and payments, missed work, expenses, property loss, benefit activity, and concrete functional changes. Serious harm does not by itself establish another actor’s conduct.
Compare favorable proof with alternative causes and inconsistencies. A reliable screen identifies what is known, what is disputed, and which missing source could change the conclusion. Claims should not be valued by a diagnosis label or bill total before responsibility and causal support are examined.
Run the Fault, Government, Coverage, and Clock Screens
O.C.G.A. § 51-12-33 generally reduces damages by claimant fault and bars recovery when the claimant is 50 percent or more responsible, with nonparty, intentional-tort, premises, vicarious-liability, and current case-law questions requiring separate review. Evidence about the claimant’s conduct therefore belongs in the file rather than being hidden.
Verify defendants, policies, limits, exclusions, assets, event and discovery dates, releases, immunity, and special procedures. Georgia uses different ante-litem statutes for state, county, and municipal claims. Section 9-3-33 commonly provides a two-year personal-injury period, but the exact cause of action and timing facts can differ. At S&S Law, we help Atlanta clients with potential injury claims.
