Value an Orange Claim With a Versioned Evidence Model
No universal formula fixes the value of an Orange injury claim. The supported range moves with liability, comparative responsibility, medical causation, legally available losses, evidence quality, witness and expert risk, insurance or assets, liens, expense, procedural posture, and requested resolution terms.
An attorney for injury claim valuation should present a reasoned range with stated assumptions. An accident lawsuit may change available evidence and risk, so the model should be updated rather than treated as a permanent first estimate.
Construct the Supported Damages Ledger
List medical, income, property, service, and other potentially recognized losses in separate rows. For each, show amount, source, causal basis, paid or projected status, legal issue, contrary evidence, and confidence level.
Describe noneconomic effects through dated function and corroboration rather than a multiplier. Keep speculative future harm distinct from qualified prognosis and priced recommendations.
Overlay Responsibility and Proof Risk
Model several plausible allocations using California’s comparative-fault framework, then identify the evidence that could move the percentage. Separate direct actors, employers, owners, controllers, product participants, and nonparty questions.
Score witness availability, authenticity, expert foundation, inconsistent records, prior conditions, later events, and adverse proof. A large loss figure cannot cure a weak causal or responsibility link.
Apply Coverage and Collection Constraints
Confirm policy identity, limits, exclusions, priority, multiple claimants, reservations, UM or UIM questions, excess sources, assets, insolvency, and enforcement cost. Do not assume a judgment figure equals collectible funds.
Calculate the possible client net by separately listing legal fees, litigation spending, treatment balances, asserted liens, repayment claims, and any other reviewed obligation. Label every unresolved deduction.
Version the Range at Material Milestones
Create a dated model after investigation, medical clarification, coverage decisions, demand response, key discovery, expert opinions, motions, and mediation. Preserve the prior version and state exactly why the range changed.
The model supports advice; it does not promise an outcome. A credible valuation tells the client what is known, what is contested, and which next fact is worth obtaining.
Add a sensitivity table showing which assumption changes the net range most. That directs spending toward a material uncertainty instead of accumulating records that do not affect the decision.
Record the date, author, inputs, and unresolved questions for every revision so the client can compare changes without confusing estimates with guarantees. At S&S Law, we help Orange clients with claim valuation.
