An Orange Filing Deadline Starts With Classification
California Code of Civil Procedure section 335.1 commonly supplies a two-year limitations period for specified actions based on assault, battery, or injury or death from another’s wrongful act or neglect. That general rule is not universal; classification, accrual, defendant identity, medical-care rules, age or capacity, discovery issues, tolling, and specialized statutes can alter the analysis.
Ask an attorney for injury claim deadline analysis to calculate from verified facts instead of the event label. Waiting for negotiations, treatment completion, or a final insurance answer can be dangerous because those activities may not extend the time to start an accident lawsuit.
Identify Every Defendant Before Counting
List the driver, owner, employer, property controller, contractor, product company, medical provider, public agency, and any other supported party. Record its exact legal name and why it may be responsible, because different defendants can trigger different procedures and dates.
For a California government claim relating to personal injury or death, the ordinary presentment period is generally six months after accrual, and statutory presentment ordinarily must occur before suit. Recipient, form, content, service, late-claim relief, rejection, and the later court deadline all require exact review.
Separate Five Dates on the Calendar
Track the event date, legally determined accrual date, any administrative or contractual notice date, the filing date, and evidence-preservation dates. Also note minority, incapacity, concealment, prior proceedings, bankruptcy, and other facts that counsel must evaluate rather than assuming they pause time.
Create a source column for each entry: statute, policy, notice, order, agreement, or docket. An unsupported calendar date is not a reliable deadline analysis.
Treat the Earliest Plausible Date as Urgent
Preserve documents and seek review before the shortest potentially applicable period expires. Do not file an incomplete or misdirected notice merely to feel protected; the correct party, procedure, and content matter.
A deadline opinion should state the assumptions, unresolved facts, controlling authority, calculation, and backup date. That written matrix is more useful than repeating “two years” without knowing which rule governs.
Calendar a review date well before the earliest candidate deadline. The buffer allows time to correct defendant names, gather required content, confirm service details, and resolve whether an administrative prerequisite applies.
